Marriage 27 Sep 1819 at Wigston Magna, Leicestershire of Thomas Heard to Mary VANN; Anglican; both were of the parish; Banns; witnesses John Twain, Samuel Freer (ref fmp Leicestershire Marriages image). The most likely baptism for Mary Vann is 5 Apr 1797 at Wigston Magna, dau of William & Mary (nee Herbert) Vann (ref fmp Leicestershire Baptisms). There are several within 2 years apart. The Mary baptised in 1795 appears to be the one who married John Sampson, see my Sampson tree. The one in 1799 is probably the one who married Thomas Cooper in 1825.

This is the last Will and Testament of me Thomas Heard of Wigston Magna in the County of Leicester Manufacturer of Hosiery I give and bequeath to my brother William Heard four Freehold Houses and a Shop together with the yard garden and appurtenances thereto belonging situate and being in Newgate End in the Parish of Wigston Magna in the County of Leicester and now in the occupation of Thomas Boulter Charles Hurst Ann Spence and David King for his sole and separate use absolutely. I also give and bequeath to my Brother William Heard aforesaid all my household goods and furniture whatsoever and wheresoever together with all my stock of Hosiery goods. I give and bequeath to my Brother John Heard the Freehold House Shops Garden and all the appurtenances thereto belonging which I now occupy situate in Moat Street in the Parish of Wigston Magna in the County of Leicester. I also give and bequeath to my Brother John Heard aforesaid Five other Freehold Houses together with the yards gardens and appurtenances thereto belonging which joins the first named Messuage situate in Moat Street in the Parish of Wigston Magna in the County of Leicester now occupied by Samuel Green Henry Dann Thomas Silverwood Joseph Glover and Henry Hill The aforesaid Property which I have given and bequeathed to my Brother John Heard aforesaid shall be subject to the following Legacies. I give and bequeath to my Sister Ann Hill the Wife of Samuel Hill of Leicester the sum of Fifty Pounds free from Legacy Duty for her sole and separate use and free from the control and debts of her husband at the time of my decease and her receipt alone shall be a good discharge for the same. I give and bequeath to my Sister Sophia Davenport the Wife of Charles Davenport of Wigston Magna the sum of Five pounds for her sole and separate use and free from the Debts and control of her husband at the time of my decease and her receipt alone shall be a good discharge for the same. I give and bequeath to my Niece Catherine Boulter the Wife of Thomas Boulter of Wigston Magna the sum of Five Pounds and her receipt alone shall be a good discharge for the same. I give and bequeath to my Niece Ruth Newby the Widow of Thomas Newby of Wigston Magna the sum of Five Pounds and her receipt shall be a good discharge for the same and I give and bequeath to my Niece Mary Weston the Wife of John Weston the sum of Five pounds and her receipt shall be a good discharge for the same. The aforesaid Legacies shall be paid within six Calendar Months of my decease. I give and bequeath to my Nephew Thomas Heard of Wigston Magna all my Machinery Framework and all the Implements belonging to the aforesaid Machinery. I give and bequeath to my Brother William Heard aforesaid and to my Brother John Heard aforesaid all my money and securities for money not before disposed of Upon the following trust to pay all my just Debts, Funeral and Testamentary Expenses, if there should be any money left in their hands after the aforesaid Expenses are paid it shall be equally divided and paid to all my surviving Brothers and Sisters. And lastly I do nominate and appoint my Brother William Heard aforesaid and my Brother John Heard aforesaid Executors of this my Will. In Witness whereof I have hereunto set my hand this twentieth day of February one thousand eight hundred and seventy one.

The Testator Thomas Heard was late of Wigston Magna in the County of Leicester Manufacturer of Hosiery and died on the twenty fourth day of March 1871 at Wigston Magna aforesaid.   Under £ 300.

Note: Niece Catherine Boulter, the wife of Thomas Boulter, was born 1810, daughter of Joseph Vann and Catherine Davenport. This Joseph, born in 1786 to William & Ruth Vann was probably the half brother of Mary Vann above, daughter of the same William, and Mary Herbert, after Ruth died.
Ruth Newby, the widow of Thomas Newby, born 1808, was Catherine Boulter's sister.
Mary Weston was another Vann relative.

Despite it stating 's' for son, this is the best fit for Sophia, and her brother Thomas, the only other uncertainty, appears to be about 2 years older.

This is the last Will and Testament of me Charles Davenport of Wigston Magna in the County of Leicester retired Publican. I give and bequeath to my Wife Sophia Davenport all my Money and securities for Money with all the Furniture and all other effects belonging to me whatsoever and wheresoever for her life. After her Death I give and bequeath to my Niece Selina Thorpe, Wife of Samuel Thorpe all the aforesaid Furniture and all other Effects belonging to me. I give and bequeath to my Sister Jane Gamble the sum of Ten Pounds. I give and bequeath to my Sister Ann Hill the sum of Ten Pounds. I give and bequeath to my Sister Hannah Preston the sum of Ten Pounds. I give and bequeath to my Sister Sarah Coltman the sum of Ten Pounds. I give and bequeath to my Sister Harriet Groves the sum of Ten Pounds. I give and bequeath to my Nephew Charles Davenport the sum of Ten Pounds. William was a member of the British Army in Canada, in 48th Foot, 17th Foot, 1st Battn (ref an undated listing in Ancestry).
His UK Royal Hospital Chelsea Pensioner Soldier Service Records state that he was in the Royal Regiment of Artillery, enlistment year 1823, discharge year 1846 (ref Ancestry).

Marriage 16 Feb 1829 at St Mathews, Halifax, Nova Scotia, Canada of William Heard to Sarah Jane WATT (ref APT). Sarah was born 1810 at Halifax, Nova Scotia (ref APT). The children were born 1828-1830 in Canada, 1834 in Kent, England, 1837-1843 in Canada, 1845 in Kent, 1847-1851 in Leicestershire.

In 1836 at the baptism of son Thomas, William was described as "Gunner in Captain Camerons Company Sixth Battalion of His Majesty's Royal Artillery" (ref Ancestry, Quebec Vital and Church Records".

In 1841 they were still in Canada, returning to England between 1843 and 1845 while still on active service.

This is the last Will and Testament of me John Heard of Great Wigston in the County of Leicester Hosier First I appoint my nephews Arthur Foulston and Enoch Foulston both of Great Wigston aforesaid (sons of my sister Harriet Groves by her first marriage) joint Executors and Trustees of this my Will I Give and Devise All that my Messuage or Tenement with the yard garden outbuildings and appurtenances thereto belonging And also All that my two storey Warehouse and those by two Frameworkknitter’s shops adjoining or near thereto respectively situate and being in Hospital Lane Great Wigston aforesaid and all now in my own occupation Subject nevertheless to and charged and chargeable with the payment of one half part of the Mortgages for Five hundred Pounds now due thereon and on I give and bequeath to my Sister Harriet Groves the Wife of William Groves of Mountsorrel the sum of Fifty Pounds free from Legacy Duty for her sole and separate use and free from the control and Debts of her husband at the time of my decease and her receipt alone shall be a good discharge for the same.

In 1877 Harriet received a legacy from her brother-in-law Charles Davenport:
WILL OF CHARLES DAVENPORT (signed 24 Feb 1877; deceased 6 Apr 1877; proved 19 Jun 1877)
I give and bequeath to my Sister Harriet Groves the sum of Ten Pounds.

"GROVES Harriet. Personal Estate £40 19s. 3d. 2 April. Administration of the Personal Estate of Harriet Groves late of Moat-street Great Wigston in the County of Leicester Widow who died 18 March 1890 at Great Wigston was granted at Leicester to Harriet Knight (Wife of Thomas Knight) of Abergwynfi near Bridge End in South Wales the Daughter and one of the Next of Kin." If she had been alive she would have received a legacy from her brother John Heard:
WILL OF JOHN HEARD (signed 12 Jul 1886, deceased 19 Apr 1891, proved 10 Jun 1891) (ref fmp, Leicester Probate Registry Administration Registers)
.... charged and chargeable with the payment of a Legacy of Twenty pounds to my said sister Harriet Groves to whom I Give and bequeath the same Legacy which I direct to be paid at the end of twelve calendar months next after my decease ....

WILL OF SUSANNAH HEARD (signed 16 Apr 1838, deceased 1846, proved 1851 )
This is the last Will and Testament of me Susannah Heard of Leicester in the County of Leicester Widow. I Give and Bequeath all and singular my household goods furniture plate linen and china and all my wearing apparel unto my daughter Susannah Marston [sic] Heard her Executors Administrators and Assigns for her own use. I give and bequeath all and singular any monies securities for money debts and all the rest residue and remainder of my personal Estate and Effects whatsoever and wheresoever and of what nature or kind soever unto my brother Joseph Marston of Cadeby in the said county of Leicester Farmer and my friend Mr. Benjamin Jackson of Leicester aforesaid Draper their Executors and Administrators upon Trust that they my said Trustees of the survivor of them his Executors or Administrators do and shall call in and convert into money such part of the said trust monies as shall not consist of money or securities for money and lay out and invest the same in Government or Real Securities and from time to time alter and vary such securities as they or he shall think proper. And I do hereby declare that my said Trustees and the survivor of them his Executors and Administrators shall stand possessed of the said trust monies stocks funds and securities and the interest dividends and annual produce thereof after paying thereout all my just debts funeral and testamentary expences upon trust fo rmy said daughter Susannah Marston Heard her Executors Administrators and assigns. But in case my said daughter shall depart this life under the age of twenty-one years without having been married then I direct that my said trustees and trustee for the time being shall stand possessed of such part of the said trust monies and premises as shall remain undisposed of in trust for my niece Mary Looms Marston and my nephew Benjamin Marston children of my brother Joshua Marston their Executors and Administrators in equal shares and proportions provided always and I do hereby declare that during the minority of my said daughter Susannah Marston Heard it shall be lawful for my said trustees and the survivor of them his Executors and Asministrators at their or his discretion to apply the whole or any part of the said trust monies and premises and the dividends interest and produce thereof for or towards the maintenance and support or advancement in the world of my said daughter or otherwise for her benefit as they or he shall think propeer. And I do hereby further declare that my said trustees their Executors or Administrators shall not be liable to make good any involuntary loss which may happen to the said trust monies and premises or any part thereof so as the same happen without their or either of their wilful neglect or default nor shall my said trustees or either of them be answerable or accountable the one for the other of them but each of them for his and their own acts deeds receipts payments and engagements only. And I do hereby declare this writing to be and contain my only true last Will and Testament and do appoint the said Joseph Marston and Benjamin Jackson joint Executors thereof. In witness whereof I the said Susannah Heard the Testator have to this my last Will and Testament set my hand and seal the Sixteenth day of April in the year of our Lord one thousand eight hundred and thirty eight.

William was born c1829 at Nova Scotia, Canada.
